Legal

Your Data.

Which data we process when you visit this website, why we do it and on what legal basis. In plain language, without small print hiding in the small print.

Basics

Who processes what

The relevant laws are the General Data Protection Regulation (GDPR), the Austrian Data Protection Act and the Telecommunications Act 2021 (TKG 2021).

Controller

The controller within the meaning of Art. 4(7) GDPR is:

Agentur Freudebringer GmbH
Köstlergasse 6-8 / Stiege 2 / Tür 15, 1060 Vienna, Austria
office@freudebringer.com · +43 1 99710477

Please direct questions about data protection to office@freudebringer.com with the subject “Data protection”.

Access data and server log files

When you visit this website, our hosting provider automatically stores data in so-called server log files. The following is recorded:

  • Name of the page or file accessed
  • Date and time of access
  • Amount of data transferred and message confirming successful access
  • Browser type and version and operating system used
  • Referrer URL, i.e. the page visited before
  • IP address and requesting provider

This processing is based on our legitimate interest under Art. 6(1)(f) GDPR in the secure, stable and optimized operation of the website. The log files are deleted after a short time unless they are needed to clarify a specific suspicion of misuse.

Contact and forms

When you contact us via a form, by email, by phone or via WhatsApp, we process the details you send us in order to handle your inquiry and for any follow-up questions. We use Contact Form 7 for the forms on this website; the data is delivered to our email address.

The legal basis is Art. 6(1)(b) GDPR where the inquiry aims at a contract, otherwise our legitimate interest under Art. 6(1)(f) GDPR in answering inquiries. We delete the data as soon as it is no longer required. Statutory retention obligations remain unaffected.

Comments on the blog

If you leave a comment on a blog post, we store not only the comment but also the name and email address you give and your IP address. We store the IP address because, as operator, we can be held liable for unlawful content in comments and therefore have a legitimate interest in being able to identify the author.

The legal basis is your consent under Art. 6(1)(a) GDPR for the publication of the comment and our legitimate interest under Art. 6(1)(f) GDPR in defending against unlawful content. Comments remain stored until you request their deletion or we remove them.

Registration as a network partner

You can register for our network of trusted partners via the partner form. We process the contact, location and business data given there in order to review your registration, admit you to our network and offer you suitable campaigns.

The legal basis is Art. 6(1)(b) GDPR, i.e. initiation and performance of the partner relationship. The data is stored for the duration of the partnership and afterwards retained within the framework of statutory retention obligations.

Newsletter via Brevo

We use Brevo, a service of Sendinblue GmbH, Köpenicker Straße 126, 10179 Berlin, Germany, to send our newsletter. We need a valid email address for registration. Registration uses the double opt-in procedure: after you sign up you receive a confirmation email.

We store your IP address and the time of registration in order to be able to prove a lawful registration. Brevo processes the data for us as a processor, and a contract under Art. 28 GDPR is in place.

The legal basis is your consent under Art. 6(1)(a) GDPR. You can withdraw it at any time via the unsubscribe link in every newsletter or by message to us. Brevo’s privacy information: brevo.com/de/legal/privacypolicy

Embedded videos from YouTube

On individual pages we embed videos from YouTube, a service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The videos are only loaded after you have expressly agreed to the embedding. Before that, no connection to YouTube is established.

When a video is played, data such as your IP address and your usage behavior are transmitted to YouTube. If you are logged in to your Google account, YouTube can assign this data to your profile. This may involve a transfer to the USA.

The legal basis is your consent under Art. 6(1)(a) GDPR. Google’s privacy information: policies.google.com/privacy

Google Tag Manager and Google Ads

We use Google Tag Manager to manage measurement codes on this website. The Tag Manager itself does not create usage profiles; it controls the delivery of further services.

Through the Tag Manager we integrate Google Ads conversion tracking. This allows us to see whether users carry out a certain action on our website after clicking one of our ads. Cookies are set and data is transmitted to Google, including to the USA.

The legal basis is your consent under Art. 6(1)(a) GDPR and Section 165(3) TKG 2021. You can withdraw it at any time in the cookie settings. Google’s privacy information: business.safety.google/privacy

Spam protection through reCAPTCHA and Turnstile

To protect our forms from automated misuse, we use Google reCAPTCHA from Google Ireland Limited and Cloudflare Turnstile from Cloudflare Germany GmbH, Rosental 7, 80331 Munich. Both services analyze behavior while the form is being filled in to distinguish human input from automated input. Among other things, the IP address and browser information are processed.

The legal basis is your consent under Art. 6(1)(a) GDPR. Privacy information: policies.google.com/privacy and cloudflare.com/de-de/privacypolicy

Push notifications via WonderPush

If you subscribe to push notifications, we use WonderPush, a service of WonderPush SAS, 7 rue de la Croix Martre, 91120 Palaiseau, France. A device identifier is stored, which allows us to deliver notifications to you.

The legal basis is your consent under Art. 6(1)(a) GDPR. You can deactivate the notifications again at any time in your browser settings. Privacy information: wonderpush.com/policies/privacy

Technically necessary services

To operate the website we use services that do not create personal profiles but require technically necessary cookies. Borlabs Cookie stores your cookie decision, WPML remembers the language version you selected, and Popup Maker remembers notices that have already been shown.

The legal basis is our legitimate interest under Art. 6(1)(f) GDPR in the functioning operation of the website and Section 165(3) TKG 2021, which does not require consent for strictly necessary cookies. A complete overview of all services used can be found on the Cookies page.

Recipients and transfers to third countries

We only pass on your data to the extent necessary for the stated purposes: to our hosting provider, to the processors mentioned above, and to tax advisers and authorities where required by law.

Services from Google may involve processing in the USA. Google Ireland Limited is certified under the EU-US Data Privacy Framework, and standard contractual clauses under Art. 46 GDPR also apply. A level of data protection fully equivalent to the European level cannot be guaranteed in every case of transfer to third countries.

Storage period

We store personal data only for as long as is necessary for the respective purpose. After that we delete it, unless statutory retention obligations stand in the way, in particular the seven-year retention period under Section 132 of the Federal Fiscal Code (BAO) for tax-relevant records.

Data subject rights

Your rights

The GDPR gives you a number of rights against us. You can exercise them informally by email, free of charge and without having to give reasons.

What you can request

  • Access to whether and which data we process about you, Art. 15 GDPR
  • Rectification of inaccurate or incomplete data, Art. 16 GDPR
  • Erasure of your data where no retention obligation stands in the way, Art. 17 GDPR
  • Restriction of processing, Art. 18 GDPR
  • Data portability in a common, machine-readable format, Art. 20 GDPR
  • Objection to processing that we base on a legitimate interest, Art. 21 GDPR
  • Withdrawal of consent given, at any time and with effect for the future, Art. 7(3) GDPR

To do so, write to us at office@freudebringer.com. We respond within the statutory period of one month.
